     In Department of Fair Employment and Housing v. United Dominion Realty (Case Nos. 07CC12067, 02CC12069), the court accepted our audit findings, stating that:

“In awarding fees in these amounts, the court has fully accepted the declaration of James P. Schratz in opposition to the motion, including all of his recommended reductions. We will perform a full-scale legal fee audit, input and code all the bills, generate computer reports, read all pleadings, depositions, and correspondence, and provide a written report. If you do not believe it is the most even-handed, high-quality and unbiased legal fee audit you have ever seen, and decide not to use the audit report, there is no charge.

I can make this promise because, after conducting hundreds of audits around the country, and comparing them to other legal fee audits, I am confident that any client will immediately recognize that our audits are of the highest quality.

No Risk to the Client

            This personal pledge means that the client has no risk in hiring Jim Schratz and Associates.

A General Counsel who retains Jim Schratz and Associates to audit legal bills takes no risk.  If the General Counsel or CEO does not think the audit is outstanding, the company does not have to pay.

The insurance adjuster who retains Jim Schratz and Associates to audit outside counsel fees takes no risk.  If the adjuster does not think the audit is outstanding, the adjuster does not have to pay.

The attorney who is representing a client in a fee dispute with a prior law firm and recommends the client hire Jim Schratz and Associates takes no risk. If the client does not think the audit is of the highest quality, the client does not have to pay.

The defense attorney who is opposing a fee application by a successful plaintiff and recommends the client retain Jim Schratz and Associates takes no risk.  If the client does not think the audit is of the highest quality, the client does not have to pay

The plaintiff attorney who is submitting a fee application and wants to retain Jim Schratz and Associates to review the invoices in support of the fee application takes no risk.  If the attorney does not think the audit report is a fair, unbiased, report of the highest quality, the attorney does not have to pay our fee.

Why I Make This Unique Guarantee of a Free, No-Risk Audit Report

First, I am the owner of Jim Schratz and Associates, and I personally review all the pleadings, correspondence, and other available work product.  I do not delegate this to somebody else, so I know how much hard work went into the audit.

Second, I personally sign the audit report so I am putting my own name and reputation on the line in every audit.  I do not delegate this responsibility to somebody else.

Third, I am the only one from Jim Schratz and Associates who testifies in support of the audit at a hearing or trial.  I do not delegate that responsibility to somebody else.  I have to be completely confident in the quality of the audit before I ever get on the witness stand.

Finally, I only perform the most thorough audit possible.  I review all the invoices, all the pleadings, all the depositions, all the hearing transcripts, and all other available work product.

Many legal fee auditors only review the invoices.  This review is not fair to the client or the law firm.  It is comparable to performing legal research by only reading the “Headnotes,” instead of reading the court opinion, or for those attorneys who are car aficionados, it is comparable to taking a car to a mechanic for a check up, but not letting the mechanic look under the hood or take the wheels off and check the brake linings.  The cost will be a lot less, and so will the validity of the results.  And the mechanic will not guarantee the customer satisfaction.  Jim Schratz and Associates, when it does a legal fee audit, “looks under the hood,” “checks the brake linings,” and guarantees your satisfaction with the quality of the audit, or there is no charge.
